We are experienced at working with developers and property owners in protecting water rights, and helping clients secure new water supplies. We work with engineering consultants to perform water rights/supply investigations, and counsel clients on perfecting, protecting, and reporting those rights. We help our clients and their consultants develop water supply assessments and urban water management plans. We are also very familiar with the 2001 legislation commonly known as Senate Bill 610 and Senate Bill 221. We secure the regulatory approvals and entitlements necessary to ensure predictable water supplies for new development.
We represent our clients in complex matters involving water regulations, including stormwater runoff, wastewater, reclaimed water, and other requirements that affect real estate development and land use. We are experts in navigating and resolving the complex “clean water” requirements for development. On behalf of our clients, we:
Negotiate individual and watershed permits (MS4) for storm water discharges;
Secure Section 401 water quality certifications from various federal and state permitting authorities;
Council in the development of stormwater pollution protection plans (SWPPPs) and associated development conditions.
